Welcome to OrchidPocket.

These Terms and Conditions (“Terms”) govern your access to and use of the OrchidPocket mobile application, website and related services (“OrchidPocket”, the “App”, “we”, “us”or “our”).

OrchidPocket is operated by Elysium Innovations Ltd, a company operating under the laws of England and Wales.

By downloading, accessing, registering for or using OrchidPocket, you agree to these Terms. If you do not agree to these Terms, you must not use the App.

1. About OrchidPocket

OrchidPocket is an app that allows users to register their details and use the features made available within the App.

The App is distributed internationally, but these Terms are governed by the laws of England and Wales, unless local consumer protection laws in your country provide otherwise.

3. Eligibility and age requirements

OrchidPocket is for use by users aged 13 and above.

If you are under the age at which you can legally consent to the processing of your personal data in your country, your parent or legal guardian must give permission for you to use OrchidPocket.

4. Account registration

To use certain features of OrchidPocket, you may need to create an account and register your details.

You agree that the information you provide will be accurate, complete and kept up to date.

You are responsible for keeping your login details secure. You must not share your account login details with anyone else, except where a parent or guardian is helping a child manage their account.

You must contact us immediately at support@orchidpocket.com if you believe your account has been accessed without permission.

5. Privacy and personal data

We respect your privacy.

OrchidPocket allows users to register their details, but we do not sell, rent, trade or share your personal data with any other party for marketing, advertising or commercial purposes.

Your personal data will be handled in accordance with our separate Privacy Policy, which explains what information we collect, why we collect it, how we use it, how long we keep it and how users or parents/guardians can request access, correction or deletion.

6. No third-party data sharing

Elysium Innovations Ltd does not share users’ registered personal details with third parties for their own independent use.

We confirm that OrchidPocket does not currently use third-party analytics, crash reporting, cloud database providers, email providers, third-party SDKs or similar external service providers.

If this changes in the future, we will update our Privacy Policy and where required, notify users or obtain consent before introducing any new data processing.

Please note that if OrchidPocket is downloaded through an app store, such as the Apple App Store or Google Play, your use of those platforms may also be subject to their own terms and privacy policies.

7. Acceptable use

You agree not to use OrchidPocket to:

• Break any law or regulation.
• Provide false, inaccurate or misleading registration details.
• Access or attempt to access another user’s account.
• Interfere with the security, operation or availability of the App.
• Upload or transmit malware, viruses, harmful code or disruptive material.
• Copy, modify, reverse engineer or misuse the App.
• Use the App in a way that may harm Elysium Innovations Ltd., OrchidPocket, other users or any third party.
• Attempt to bypass any age, security or account verification measures.

We may suspend or terminate your account if we reasonably believe you have breached these Terms.

8. User information and content

If OrchidPocket allows you to submit, upload, store or manage information, you are responsible for ensuring that the information is accurate and lawful.

You must not submit information that:

• Belongs to someone else without permission.
• Is false, misleading, abusive, unlawful or harmful.
• Infringes another person’s rights.
• Contains malicious software or harmful content.

You give us permission to use, store and process your submitted information only as necessary to provide and operate OrchidPocket.

9. Children’s use of OrchidPocket

OrchidPocket should not be used by children under the age of 13.

If you are a parent or guardian and believe that your child has created an account without your permission, you can contact us at support@orchidpocket.com and request that the account be reviewed or deleted.

10. Account deletion

Users can delete their account within the App.

When an account is deleted, we will delete or anonymise the personal data associated with that account, unless we are required or permitted to keep limited information for legal, security, fraud-prevention, dispute-resolution or operational reasons.

11. App availability

We aim to keep OrchidPocket available and functioning properly, but we do not guarantee that the App will always be available, uninterrupted, secure or free from errors.

We may suspend, restrict, update or discontinue all or part of the App where necessary for maintenance, security, legal, technical or business reasons.

12. Updates to the App

We may update OrchidPocket from time to time to improve performance, add or remove features, fix bugs, maintain security or comply with legal requirements.

Some updates may be required for continued use of the App. If you do not install required updates, some features may not work correctly.

13. Fees, subscriptions and in-app purchases

OrchidPocket is initially provided free of charge.

In the future OrchidPocket may offer paid features, subscriptions or in-app purchases.

If paid features are introduced, the price, billing period, renewal terms, cancellation process and any other important payment terms will be shown before you make a purchase.

Where purchases are made through the Apple App Store, Google Play or another app marketplace, your payment and cancellation rights may also be governed by that platform’s own terms and conditions.

You will not be charged for paid features unless you choose to purchase them.

14. Intellectual property

OrchidPocket, including its name, branding, logo, design, software, features, content, text, graphics and other materials, belongs to Elysium Innovations Ltd or its licensors.

You are granted a limited, personal, non-exclusive, non-transferable licence to use OrchidPocket for its intended purpose.

You must not:

• Copy, reproduce or distribute the App.
• Modify, adapt, translate or create derivative works from the App.
• Reverse engineer, decompile or attempt to extract the App’s source code, except where the law allows.
• Use OrchidPocket’s name, logo or branding without our written permission.

15. Third-party platforms

OrchidPocket may be made available through third-party platforms, including app stores.

Those platforms may have their own terms, conditions and privacy policies. We are not responsible for the operation, policies or practices of third-party platforms.

16. Suspension and termination

We may suspend or terminate your access to OrchidPocket if:

• You breach these Terms.
• You misuse the App.
• You provide false or misleading information.
• Your use of the App creates legal, security, technical or operational risk.
• We are required to do so by law.
• We discontinue the App or a material part of it.

You may stop using OrchidPocket at any time and may delete your account within the App.

17. Disclaimer

OrchidPocket is provided on an “as is” and “as available” basis.

We do not guarantee that:

• The App will always be available.
• The App will be error-free or uninterrupted.
• The App will meet every user’s specific requirements.
• Any stored information will always be complete, current or suitable for a particular purpose.

Nothing in these Terms affects any legal rights you may have as a consumer.

18. Limitation of liability

To the fullest extent permitted by law, Elysium Innovations Ltd will not be liable for:

• Indirect or consequential losses.
• Loss of profit, revenue, business, opportunity or goodwill.
• Loss caused by your misuse of OrchidPocket.
• Loss caused by unauthorised access resulting from your failure to keep your login details secure.
• Loss caused by events outside our reasonable control.
• Loss caused by third-party platforms, app stores or payment providers.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot be excluded under applicable law.

19. International use

OrchidPocket is distributed worldwide.

You are responsible for ensuring that your use of OrchidPocket complies with any laws that apply to you in your country or location.

We do not guarantee that OrchidPocket is appropriate, available or legally permitted in every country.

20. Changes to these Terms

We may update these Terms from time to time.

If we make significant changes, we will take reasonable steps to notify users, such as by updating the “Last updated” date, displaying a notice in the App or contacting users where appropriate.

By continuing to use OrchidPocket after changes take effect, you agree to the updated Terms.

21. Governing law and disputes

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes relating to these Terms, unless applicable consumer protection laws in your country give you the right to bring a claim elsewhere.
